New Delhi: The Delhi High Court stayed the order of a special court that allowed Satyendar Jain to counsel during the Enforcement Directorate’s interrogation on Saturday.
The Enforcement Directorate moved to the High Court challenging the order of the special court which was allowing the Health Minister to have counsel in the process of interrogation. The High Court earlier reserved its order in the matter.
Further, the Delhi Minister is in the custody of ED till June 9 in connection with a money laundering case. Justice Yogesh Khanna while passing the order said that “Since there is neither any FIR nor a complaint against the respondent, he cannot, as a matter of right, claim to have the presence of his lawyer during the course of recording of his statement as per the judgement in the case of Ramesh Chander Metra and Anant Brahmachari.”
Further, the court added that the interrogation will be video graphed and autographed. Additional Solicitor General S.V.Raju said that the order of the special judge is without reasoning. He further added that Satyendar Jain is not an accused hence he is not entitled to this relief.
