Act on complaint by lawyer on assault, says HC

    Chennai, Aug 17 (PTI): Madras High Court has directedpolice to act on a complaint by a city lawyer againstadvocates of Thiruvannamalai Bar Association that they hadassaulted him after questioning his presence there when he hadgone to attend a case. Justice P N Prakash passed the orders on a CriminalOriginal Petition filed by D Balaji, who sought a direction toregister a case on his complaint which he had sent byRegistered Post to police in that town. Balaji submitted he had gone to the police station inthat town to file a complaint, but around 25 lawyers from thelocal bar prevented him from appearing before the policeofficer concerned. "Petitioner is directed to appear before the respondentpolice in person and lodge a fresh complaint containing thevery same contents filed previously dated July 15 2016. Thesame should be enquired into separately and action be taken inaccordance with law if it discloses cognizable offence or dropaction otherwise." Balaji submitted that he had gone to District SessionsCourt at Thiruvannamalai on July 14 to file a section forenquiry about a Criminal Miscellaneous Petition. Thiruvannamalai Bar Association president V Ramakrishnan andVice president G Rajendran approached him and questionedhis credentials and demanded his ID card,which he showed. Ramakrishnan then suddenly started shouting at him andasked him if he was a big shot and was going to appear beforedistrict Court on July 15, to which he replied he had onlycome to note some details with regard to a case. To this, Ramakrishnan told the petitioner he was anadvocate in Madras High court and questioned his necessity tocome to the town, took the ID card along with him and askedhim to follow him. Balaji submitted that another lawyer standing nearbymade a phone call, following which about 10 to 15 advocatescame to the spot, started abusing him in filthy language andthen assaulted him. Balaji submitted he did not file a complaint beforepolice due to severe pain after the assault and for securityreasons sent it through Registered post to them on July 15,forwhich he was given CSR (Community Service Receipt).
