India has a chance to step alongside the progressive countries and repeal Section 377 as the law is ‘archaic’ and has no place in the 21st Century.
Now that the Supreme Court will refer the case to a larger bench to discuss the decriminalization of gay sex between two consenting adults.
The bench includes Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud and they said the issue arising out of Section 377 needs to be debated upon by a larger bench.
The Section 377 calls gay sex as “unnatural offences” and declares whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to 10 years, and shall also be liable to pay a fine.
It’s time that India also takes a step forward to junk this obsolete law and give people the option to make their own choice.
