All you need to know about today’s ‘no-confidence motion’

The debate over the no-confidence motion is underway in the Lower House of the Parliament. The first speaker was Jayadev Galla from the TDP who led an aggressive factual attack on the government’s discrimination towards Andhra Pradesh and the special status awarded to it.

It was followed by Rakesh Singh of the BJP who attacked the Gandhi family and said Congress played politics with scams while BJP has governed with schemes.

Then Rahul Gandhi started his speech with Jumla and ended it with Jhappi.

“Galla and others are victim of 21st century political weapon called Jumla strike. Symptoms are: excitement, happiness, feeling of shock and 8-hour long speeches. Victims of Jumla are – farmers, youngsters, women and Dalit,” he said.

 

Events leading to No-Confidence motion

The opposition parties led by the Congress and the TDP moved a no-confidence motion against the ruling NDA government on the first day of the monsoon session of the parliament. The Speaker of the Lok Sabha permitted the motion.

“The House will take up the debate (on the motion) on Friday, July 20th. The discussion will be held for the full day, followed by voting on it,” Sumitra Mahajan, Lok Sabha Speaker announced in the House when it reassembled after the lunch break on the first day of the Monsoon Session of Parliament.

The motion was rejected by the Speaker during the Budget Session on the grounds that the House was not in order, as there were continuous protests in the Well by opposition members on various issues.

What to expect on Friday?

  • TDP will move the no-confidence motion in the Lok Sabha at 11 am
  • Debate on the motion till 6. Time will be alloted to speakers, in proportion to the seat share in the house
  • PM will reply to the opposition
  • Vote around 8 PM

What is a ‘no-confidence motion’?

A ‘no confidence motion’ is a test of the government to prove majority in the lower house. It plays an important role in a democracy as a government can be in power as long as it has the support of the majority members in the house.

When a no-confidence motion is introduced in the house, the government has to pass a floor test i.e show it has support of atleast half the members in house. So the current Lok Sabha has 535 members. Atleast 268 members will have to give support for the government to win the motion.

The TDP has already issued a whip to its members. “Members in Loksabha are hereby inform that No-Confidence Motion will be taken up for discussion in the Loksabha on Friday,the 20th July,2018. All Members of TDP in Lok Sabha are,therefore,requested to be positively present in the House throughout two days from Thursday,the 19th July to Friday,the 20th July,2018 and support the “No-Confidence Motion “against the Council of Ministers,” K.Narayana Rao Chief Whip-TDP(Loksabha) said.

What is the procedure to move the motion in the House?

  • A no-confidence motion can be moved by any member of the House by giving a written notice. The member need not give a reason for moving the no-confidence motion. It can be moved only in the Lok Sabha and not Rajya Sabha.
  • No confidence motion in Lok Sabha can be only be introduced if
(1) the member asking for leave shall that day give to the Secretary-General a written notice of the motion which such member proposes to move.

(Provided that notices, received after 10.00 hours, shall be deemed to have been received at 10.00 hours on the next day on which the House sits.)

(2) If the speaker feels that the motion is right, he shall read the notice in house with support of no less than 50 members.

  • Once the motion is accepted speaker will announce a day when , the motion is discussed. The day cannot be more than 10 days of the day motion is accepted.
  • Speaker can allot one day, multiple days or part of a day for discussions.
  • The vote is then be conducted on a specified hour or on the last day of discussion.
  • There is no time limit between two confidence motions
  • The vote is conducted in voice vote , which means if a person is in favour of the motion will say “aye” and the person not in favour will say “no”. The votes are recorded on the basis of number of “Aye” and “No”
  • If voice vote is not clear then the LS speaker calls for a division of vote. The division bell rings continuously for three and a half minutes and so do many connected bells all through Parliament House and Parliament House Annexe. MPs from all parties file into the chamber and the doors are closed. The votes are recorded by the Automatic Vote Recording Equipment.

Is this the first time ‘no-confidence’ motion is being passed?

No, this is not the first one. Till date 26 no-confidence motions moved in the parliament.

  • The most iconic was in 1999 when Atal Bihari Vajpayee’s government lost the trust motion by 1 vote
  • First no confidence motion was moved against Jawaharlal Nehru in 1963
  • Governments led by Indira Gandhi faced the most – 15 , while Lal Bahadur Shastri, PV Narashima Rao and Atal Bihari Vajpayee faced 3 each.
  • Charan Singh resigned  in 1979 without moving of motion when Congress withdrew it’s support.
  • Morarji Desai resigned before facing no confidence motion 1979
  • Chandra Shekar won the trust motion in 1990 when he joined hands with the Congress but resigned after 5 months when Congress withdrew support.
  • H.D Deve Gowda won trust motion in 1996 but resigned 10 months later when Congress withdrew it’s support.
  • Atal Bihari Vajpayee resigned only 13 days after forming the government in 1996 before the confidence motion was put to vote.
  • IK Gujral won no-confidence motion in 1997 but resigned 7 months later when Congress withdrew support to the United Front government.
  • In 2003, the no-confidence motion against the BJP government of Atal Behari Vajpayee, by then leader of opposition Sonia Gandhi was defeated .
  • In 2008, the Dr Manmohan Singh led UPA faced a confidence vote – in which the government tests whether it still has enough numbers in parliament – after the Left pulled out support over the India-US nuclear deal. He won the trust vote by a bigger margin than expected
